These Terms of Use and Sale govern access to and use of the YA’NOO platform. Using the application implies full and unreserved acceptance of these terms.

1. About the platform

YA’NOO is a digital platform that lets users order meals, food products and delivery services from restaurants, partner vendors and independent riders.

2. Definitions

Customer

Any person using the application to place an order.

Partner

A restaurant, vendor or merchant offering its products on YA’NOO.

Rider

An individual or legal entity carrying out the transport of orders.

Platform

The YA’NOO mobile application and services.

3. Creating an account

To use certain features, the user must:

  • be at least 18 years old;
  • provide accurate information;
  • keep their information up to date;
  • keep their credentials confidential.

YA’NOO reserves the right to suspend or delete any fraudulent account.

4. Services offered

YA’NOO notably enables:

  • browsing partner catalogues;
  • ordering products;
  • online payment or via the methods offered;
  • tracking deliveries;
  • communicating with customer support.

5. Partner responsibilities

Partners undertake to:

  • provide compliant products;
  • comply with applicable hygiene and safety standards;
  • keep their menus and availability up to date;
  • process orders within the stated times.

Partners remain solely responsible for the quality of the products sold.

6. Rider responsibilities

Riders undertake to:

  • meet the stated delivery times;
  • transport products in good conditions;
  • behave in a professional and respectful manner.

YA’NOO may suspend or deactivate any rider who fails to meet these requirements.

7. Prices and payment

Displayed prices include:

  • the product price;
  • any service fees;
  • applicable delivery fees.

The customer confirms the total amount before payment.

YA’NOO reserves the right to change its prices at any time.

8. Order cancellation

Before preparation

The customer may cancel an order if it has not yet been accepted or prepared.

After preparation

No refund may be claimed except in exceptional cases approved by YA’NOO.

9. Refunds

A refund may be granted, in particular, in the event of:

  • an order not delivered;
  • a manifest error in the order;
  • a product unfit for consumption;
  • a problem attributable to the platform.

Any request must be made within 24 hours of delivery.

10. Loyalty programme and promotions

YA’NOO may offer:

  • promotional codes;
  • discounts;
  • loyalty programmes;
  • special offers.

These benefits may be modified or withdrawn at any time.

11. Intellectual property

All elements present in the application are the exclusive property of YA’NOO:

  • logo;
  • trademark;
  • interface;
  • content;
  • technologies.

Any unauthorised reproduction is prohibited.

12. Personal data

YA’NOO collects certain data necessary for:

  • account creation;
  • order management;
  • delivery;
  • improving services.

Data may include:

  • name;
  • phone number;
  • address;
  • location;
  • order history.

YA’NOO undertakes to protect users' data in accordance with applicable laws.

13. Geolocation

The application may use geolocation in order to:

  • improve deliveries;
  • identify the customer’s address;
  • provide real-time tracking.

The user may disable this feature, which may limit certain services.

14. Limitation of liability

YA’NOO acts as a technological intermediary between users, partners and riders.

YA’NOO cannot be held liable for:

  • indirect damages;
  • loss of revenue;
  • delays due to circumstances beyond its control;
  • incorrect information provided by partners.

15. Prohibited behaviour

It is prohibited to:

  • use the application for fraudulent purposes;
  • impersonate others;
  • disrupt the operation of the platform;
  • publish illegal or offensive content.

Any breach may result in immediate suspension of the account.

16. Force majeure

YA’NOO cannot be held liable in the event of:

  • natural disaster;
  • widespread network outage;
  • civil unrest;
  • an administrative decision preventing performance of the service.

17. Changes to the terms

YA’NOO reserves the right to modify these terms at any time.

Users will be informed of significant changes through the application or by notification.

18. Governing law and dispute resolution

These terms are governed by Cameroonian law.

In the event of a dispute, the parties undertake to seek an amicable solution before any legal proceedings.

Failing agreement, the competent courts of Cameroon shall have sole jurisdiction.

Restaurant and vendor terms

Obligations

Partners undertake to:

  • provide accurate information;
  • comply with applicable health standards;
  • keep their availability up to date;
  • prepare orders within the stated times.

Commission

YA’NOO charges a commission of 15% on each order placed through the platform, unless otherwise agreed.

YA’NOO charges a service fee of 5% on each order placed through the platform and paid by mobile payment, unless otherwise agreed.

YA’NOO charges a service fee of 10% on each order placed through the platform and paid in cash, unless otherwise agreed.

Delays and cancellations

Repeated cancellations or excessive delays may result in:

  • a warning;
  • a temporary suspension;
  • termination of the partnership.

Quality

Partners remain responsible for:

  • the quality;
  • the compliance;
  • the food safety of the products offered.

Rider terms

Status

Riders act as independent contractors unless otherwise stated.

Obligations

Riders must:

  • meet delivery times;
  • behave professionally;
  • preserve the integrity of orders;
  • wear the required equipment.

Suspension

YA’NOO may immediately suspend a rider account in the event of:

  • fraud;
  • theft;
  • assault;
  • accumulation of negative ratings.

Insurance

The rider remains responsible for their personal insurance, their vehicle and the authorisations required for their activity.

Refund policy

Eligible cases

The customer may obtain a refund if:

  • the order was never delivered;
  • the product is significantly different from the order;
  • the order is unfit for consumption;
  • a major error is found.

Non-eligible cases

No refund will be granted for:

  • a change of mind;
  • an incorrect address provided by the customer;
  • the customer being unavailable at delivery.

Deadline

Any claim must be made within 24 hours of delivery.

Promotional code terms

Use

Promotional codes:

  • have a limited duration;
  • may be subject to a minimum purchase amount;
  • are non-refundable.

Prohibitions

It is prohibited to:

  • resell a promotional code;
  • create multiple accounts to obtain multiple discounts.

YA’NOO may cancel any promotion obtained fraudulently.

Referral programme

How it works

A user can refer a new customer using a unique link or code.

Rewards

YA’NOO may grant:

  • delivery credits;
  • discounts;
  • vouchers.

Fraud

Any attempt to create fake accounts results in:

  • cancellation of rewards;
  • suspension of the account.

Use of customer reviews

Authorisation

By posting a review on YA’NOO, the user authorises YA’NOO to:

  • display this review;
  • reproduce it;
  • use it in its marketing communications.

Moderation

YA’NOO reserves the right to remove any content that is:

  • abusive;
  • defamatory;
  • discriminatory;
  • fraudulent.

Anti-fraud policy

YA’NOO monitors suspicious behaviour aimed at:

  • manipulating promotions;
  • circumventing payments;
  • diverting orders;
  • impersonating other users.

Any fraud may result in:

  • immediate suspension;
  • deletion of the account;
  • legal proceedings.

Mobile Money payment terms

Payments made via:

  • Orange Money
  • MTN Mobile Money
  • bank cards
  • other methods offered

are considered final once validated.

YA’NOO never stores users' secret codes or payment credentials.

Partner non-compete clause (optional)

Partner restaurants undertake not to divert users acquired through YA’NOO off the platform in order to avoid the applicable commissions.

Extended force majeure clause

YA’NOO cannot be held liable for interruptions due to:

  • power outages;
  • Internet outages;
  • social unrest;
  • natural disasters;
  • administrative decisions;
  • events beyond its control.
